  • TERMS AND CONDITIONS

    1. HEALTH AND SAFETY

    1.1 You must ensure safe access to the work site and property. While all due care will be taken, Beach Joinery Services won’t be held accountable for any loss or damage to the property, unless we have been negligent. 

    1.2 All vulnerable persons such as children, elderly and pets on the property must be kept away from the worksite.

    1.3 Anything dangerous at the worksite or property must be brought to our attention prior to arrival.

    2. AUTHORISATION, OWNERSHIP AND PERMITS

    2.1 You will ensure all consents and permits are obtained prior to the commencement of work. Beach Joinery Services will not be held responsible for work done in breach of council or any other entity.

    2.2 You warrant that you own the property or have absolute rights to authorise the work done on or to the property. Beach Joinery Services will not be liable for any cost, claim, loss or damage caused by carrying out work that was not authorised.

    2.3 You are responsible for insuring the property for the duration of the work.

    2.4 The products used or intended to be used will remain the property of Beach Joinery Services until the invoice is paid in full.

    3. PAYMENT

    3.1 Payment is required upon completion of the work, with an invoice provided containing details of price, payment method and due date.

    3.2 Some work requires a deposit in advance.

    3.3 Unpaid invoices will incur interest of 20% per annum calculated daily on unpaid balance from the due date as shown on invoice until payment is received.

    3.4 You will be liable for all costs incurred by Beach Joinery Services in collecting or enforcing any payment.

    3.5 We do not provide statements.

    3.6 If you cancel the contract for any reason prior to completion, Beach Joinery Services may obtain all payments made and materials supplied or ordered.

    3.7 Any payment overdue by more than 14 days may result in Beach Joinery Services cancelling the contract.

    4. ADDITIONAL COSTS

    4.1 If during the undertaking of contractual work on the customer’s property we are required to pay parking fees, these costs will be included on the customer’s invoice.

    4.2 Work carried out outside of normal working hours will be charged to you at an additional rate.

    5. VARIATION OF PRICE AND PRODUCT

    5.1 No variation to price, plans or products will occur without signed authority from you and Beach Joinery Services.

    5.2 There may be minor variations to price and product in the event of product substitutions made due to unavailable parts.

    5.3 Variations may occur if the scope of work is uncertain, or if alternative or additional work needs to take place that were not previously recognised such as preliminary remedial work.

    5.4 Variations to product costs may occur if unforeseen material costs significantly increase prior or during work carried out.

    5.5 If any variation is not agreed to by you or Beach Joinery Services, the contract can be cancelled with all costs incurred up to be paid by you, and no further claim can be made against Beach Joinery Services for unfinished work.

    6 WARRANTIES

    6.1 We shall repair defective workmanship for 12 months after completion. 

    6.2 We shall arrange to replace or repair defective materials within the manufacturer’s warranty period. 

    6.3 Beach Joinery Services shall not be responsible for any claims lodged where a third party has tampered with, used the product in a way it was not intended, or where the product was not maintained.

    6.4 While Beach Joinery Services technicians take the upmost care while repairing windows and doors, due to the fragility of glass we can not be held responsible in the event of a breakage.

    6.5 While we work to the best of our ability, we can not totally guarantee the cure of leaks and draughts.

    7. DISPUTES
    
7.1 If a dispute arises between parties, we will do our best to resolve this informally. If this is not possible, then the dispute will be referred to arbitration under the Constructions Contract Regulations 2003.

    8. DELAYS BEYOND OUR CONTROL

    8.1 Neither party is liable for any delay of service or loss or damage of product caused by an event outside of our control. This includes but is not limited to natural disasters, strikes, failure of subcontractors, shortage of labour and material,  and government interference.
